"An Ordinance further to amend the Magistrates Ordinance,1890".

1. This Ordinance is designed to extend the powers of Magistrates

to erder the punishment of flogging te certain cases in which

it seemed desirable that such a power should be given.

2. Under section 85 of The Magistrates Ordinance 1890 a magistrate

has power to punish with whipping a male person convicted of

stealing from the person of any woman or child; a power,

which the Supreme Court already had under section 29 of lamt

named Ordinance 1885.

The Larceny

3. By this Ordinance it is preposed to give a magistrate power te

inflict similar punishment in the case of a male person who is

guilty of an offence of gross indecency with another male per-

son: against the provisions of section 52 of Offences against the

Person. Ordinance 1865.

4. It is also proposed to give the Magistrate power to inflict a

like penalty in the case of a male person who is guilty of an

indecent assault upon a female against the provisions of section

7 of The Protection of Women & Girls Ordinance 1897; power

already possessed by the Supreme Court under the provisions of section 3 of The Flogging Ordinance 1903.

Section 2 of the Ordinance cives the substantive section giving

effect to the proposals referred to above in § 2 & 3 of this re-

pert atome,

6. In my opinion this is an Ordinance to which His Excellency the

Governor may properly assent in the name of His Majesty and • His

Behalf.
